Mary J. Smith applied for a divorce from her husband, Richard Henry Smith, on the grounds of desertion and adultery. Mr. Dean appeared for the petitioner, who stated that she was married at the Hutt in May, 1887. Her husband deserted her without any warning in 1894, and went away under the name of Morton Prior with a band of strolling players, living for some time with one of the actresses in the company. She had since seen him and written to him, but he had done nothing either for her or the children, and had admitted his adultery. His Honour granted a rule nisi, with costs, 20 guineas and disbursements, the rule nisi to be made absolute at the expiry of three months

LONDON, 2nd March.
In the New Zealand appeal case, Reginald Palmer Greville and Mary Jolly Edwards v. Crespin Parker, concerning the renewal of a lease of some land at Silverstream, Wellington, judgment has been reserved by the Judicial Committee of the Privy Council.

The case was one in which Parker had unsuccessfully failed in the Wellington Supreme Court to establish his claim for a renewal of a lease of a farm of 231 acres at Silverstream from defendants, Greville and Edwards. Mr. Justice Chapman - who heard the case - held that Parker had broken the covenant by failing to eradicate all the tauhinu on the property. Parker appealed to the Appeal Court in New Zealand, which decided that he was entitled to a decree for specific performance of the agreement for a renewal lease; but was only so entitled if he compensated respondents for any damages which they had sustained through his breaches of covenant. Respondents took the case to the Privy Council, which has reserved its decision.

THE COURT''S DECISION.
Judgment was given in the Supreme Court to-day by his Honour the Chief Justice in the case heard last week between Reginald Palmer Greville and Mary Jolly Edwards (plaintiffs) and Crespin Parker, a claim for the use and occupation of a farm known as Hayward''s Estate, consisting of 203 acres. His Honour considered the evidence, was very unsatisfactory. "The only witnesses called for the plaintiffs were a dairy farmer who had been sixteen months in the district, and the plaintiff, who was a trustee of the estate. The former, so far as I could gather," said his Honour, "had no experience in valuing farms. It is true he said he was prepared to give a rent above what the defendant had been paying, but I do not think that his one offer could properly be held to fix the value. The other witness based his estimate on what he thought the farms could yield. Suppose the farm could maintain the number of cows he thinks, his estimate of what the rent should be would leave little or no profit to the lessee. The defendant, on the other hand, has called no evidence, but rests his defence on the rent fixed nine years before in the lease, and the fact that he was to renew and at the same rent. His failure to get a renewal was because of a breach in his covenants. Part of the land had been taken by the Government, and, according to another witness, it was the most valuable part. Looking at the reason why the defendant had not given up possession, I think a fair amount for mean profits for the 25 months'' possession would be £145, for which I give judgment." Costs were allowed.
Mr. D M. Findlay appeared for plaintiffs, and Mr. H. Johnston was for defendant.
